This course is recommended for all who have attended Module 1 or are more experienced mediators.
Session 1: Navigating Complexities in Private Children Disputes (25th September)
This session delves into the challenging aspects of private children disputes, including handling allegations of harm such as abuse, substance misuse or parental alienation. You’ll learn about fact-finding hearings and their impact on mediation, the role of Cafcass and Section 7 reports, enforcement of child arrangements and strategies for managing implacable hostility. The session also covers legal considerations around relocation, both internal and international. By the end, you will better understand how complex allegations affect legal and procedural contexts, gain confidence in assessing when mediation is appropriate, and be able to identify safeguarding red flags.
Session 2: The Child’s Voice and Rights in Family Proceedings (2nd October)
Focusing on the essential role of children’s participation in family law, this session explores how and when children are heard during proceedings, including Cafcass involvement, direct engagement and the application of Gillick competence. You will learn to balance children’s views with their welfare and develop best practices for child-inclusive mediation (CIM). The session also addresses working with resistant children and those experiencing loyalty conflicts. Participants will gain a solid understanding of legal principles and case law, and practical skills to approach CIM ethically and sensitively, supporting both children’s rights and mediation goals.
